Terms of Service for the use of the 'Bike Parking' service in 7 metro stations of Lines A, B and B1

 

ART. 1 - PURPOSE AND CHARACTERISTICS OF THE SERVICE

These Terms of Service regulate the use of the "Bike Parking" service at the stations of Anagnina MA, Arco di Travertino MA, Laurentina MB, Magliana MB, Ponte Mammolo MB, San Paolo Basilica MB and Jonio MB1. Only traditional bicycles are allowed; for safety reasons electric bicycles, Fat Bikes and kick scooters are excluded at the moment.
During the first phase, the service will be free of charge and allowed only to Customers over 18 years of age who have a personalised Metrebus Card Roma or Lazio (zone A included), on which a monthly or annual pass is active.
The "Bike parking" will be running according to the opening and closing hours of the metro stations. Once the gates are closed it will not be possible for any reason to access the parking area and collect your bicycle. In the stations Ponte Mammolo MB and Jonio MB1, where the Bike Boxes are positioned near the entrances, the service is available up to 45 minutes after departure of the last metro runs from the terminals.


ART. 2 - ACTIVATION OF THE SERVICE

Customers that have a personalised Metrebus Card Roma or Lazio (zone A included) on which a monthly or annual subscription is active, can access the service through the "Bike Parking" app. At the first access it will be necessary to register, indicating name, surname, e-mail address, tax code, Metrebus Card number and to accept the Terms of Service as well as the Privacy Notice.

ART. 3 – HOW TO USE THE BIKE PARKING

To have access to the bike parking service, Customers must connect to the "Bike Parking" app and always carry the personalised Metrebus Card with them. In case of control made by the inspection staff, the failure to show the personalised Metrebus Card will preclude the use of the service. Reservations can be made starting from one hour before the time of use of the bike park.
The bicycle must be carried to the bike box by hand, following the signs. To access the stations that provide storage boxes on a different level from street level, it is mandatory to use the lifts, always following the general conditions of carriage for bicycles on public transport which can be consulted at the link www.atac.roma.it/customer-experience/general-conditions-of-carriage. The bicycle must be fixed on the bike rack inside the box without any other personal locking device (e.g. padlock). The box must then be closed following the door closing and opening procedure indicated on the app. To recover the parked bicycle, unlock the opening with the app and reposition the bike rack inside the box. With the "Family Parking" mode, it is possible to park up to 3 bicycles with a single account.
ATAC is not responsible for damage to the parked bicycles caused by other users or for damage or thefts committed or attempted, including accessory damages to valuables and other objects left in the box.

ART. 4 - ASSISTANCE

For information, problems during the provision of the service, assistance and unblocking of the box door or in the event of a malfunction, you can contact the Atac Whatsapp channel by sending a message to +39.335.1990679. The InfoAtac contact center guarantees the assistance service during the opening hours of the Rome metro network.

ART. 5 - USE OF THE BIKE PARK FOR MULTIPLE DAYS AND SUSPENSION OF THE SERVICE

Customers can leave the bicycle parked on a daily basis no longer than 14 consecutive days (maximum time that can elapse between depositing the bicycle and its recovery). In particular, after 7 days of continuous permanence of the bicycle, the user will receive a warning message, both via push notification of the APP and via email to the registered email address. After a further 7 days without removal of the bike (therefore after 14 days from the first day of parking), the controlling staff will proceed with the removal of the vehicle, which will be stored at the Atac Logistics Office depot for a maximum of 14 days. After 28 days from the first day of parking, our personnel will follow the procedure described in article 9 of this Terms of Service.
Customers acknowledge that the Service manager cannot be held responsible for any suspension or cancellation of the service, that could prevent the deposit or collection of the bicycles, for safety reasons and/or force majeure, as well as in the event of a strike and, consequently, will not be able to claim any compensation or indemnity against the same.


ART. 6 - PROHIBITED BEHAVIOUR

The following methods of using the bicycle storage are expressly prohibited:

  • parking the bicycle without having registered with the “Bike Parking” APP. This action provides for the forced removal of the parked bicycle in the event of controls by the security service;
  • parking the vehicle outside the proper spaces;
  • park electric bikes and/or kick scooters inside the box;
  • park the vehicle without anchoring it to the designated bike rack inside the box;
  • mark the boxes with signs and writings or other identification marks;
  • soil the parking area and leave waste of any kind, both inside and in its immediate vicinity;
  • stay in the structure more than for the time necessary to park the bicycle;
  • use the facility for purposes other than those set out in this regulation;
  • carry the bicycle on the escalators;
  • tie the bicycle to handrails or stair railings, even outside the stations;
  • to pedal inside the stations;
  • violate any rule of the company regulations regarding the use of bicycles on vehicles and in stations.

ART. 7 - SERVICE USER OBLIGATIONS

By subscribing to the service, Customers assume the following obligations:

  • acquire the parking authorization from the "Bike Parking" App system;
  • carefully observe the instructions set out in Article 3;
  • promptly report to the Service manager any damage caused to the structures during their use, as well as any problem related to the access/use of the Bike Parking according to the methods indicated at the entrance to each site;
  • unconditionally release the Service manager from any damage, including non-pecuniary damages, suffered by Customers during and/or on the occasion of or connected to the use of the bicycle storage area, including theft or damage to the bicycles by other people, or damages caused to third parties, natural or accidental events (e.g. acts of vandalism, etc.);
  • release the Service manager from any liability related to complaints connected to the storage and use of the Bike Parking Area and to the custody of the goods within the same;
  • report the theft of your bicycle within the bike park within the first 48 hours. Then file a regular and prompt complaint with the Judicial Authority.

The storage area is managed by ATAC without any obligation of custody. ATAC is not responsible for theft or damage to stored bicycles, individual accessories, or persons.

ART. 8 - ADMINISTRATIVE SANCTIONS

Customers that contravene the obligations referred to in the previous article, that they assumed with the registration to the service, will have to pay the Service manager the costs of any damage caused to property or persons and may also be excluded from using the service:

  • Customers who soil and/or leave waste in the parking area, will be sanctioned in accordance with current regulations and they will be as well excluded from the service;
  • in the event of repeated irregular parking within the Bike Parking, at total discretion of the Service manager, Customers may be excluded from the service, even permanently.

ART. 9 - FORCED REMOVAL

In all cases in which this Regulation foresees the forced removal of bicycles (Art.5 and Art.6), the same will be stored in the depot of the Logistics Office at the MB EUR PALASPORT stop (via Ettore Majorana) and recorded in a specific register. The progressive number will be affixed to the removed bike. Owners will be able to collect removed bikes within a maximum of 14 days, starting from the forced removal from the box, by sending a message to the Atac contact center (via Whatsapp +39.335.1990679) and specifying personal data, data relating to the parking of the removed bike and requesting its recovery. The Contact Center will transmit the request, together with the data useful for identification, to the Logistics Office which will contact the Customer, via provided phone and e-mail, within 48 hours, to agree on the time and date of collection. On that date Customers must come equipped with an identity document, the personalised Metrebus Card and the App to view all the information on the day, time and station where the parking took place. The custody staff will verify the correspondence of the applicant's declarations with the characteristics of the bicycle, will take note of the applicant's data in the register and will proceed with the delivery of the bicycle. In case of non-collection, for any reason, within the term indicated above, the bicycles will be considered as abandoned goods pursuant to Art. 923 of the Civil Code and will come into possession of Roma Capitale.

ART. 10 - FINAL PROVISIONS

For anything not expressly provided for and regulated in this document, reference is made to the regulations in force.

ART. 11 - CHANGES TO THE GENERAL CONDITIONS OF USE OF THE SERVICE

By registering for the service, Customers unconditionally accept these Terms of Service, which the Service manager has the right to modify whenever the need arises, without prejudice to the obligation to adequately publicize the modifications.
